2024 yılında gerçekleştirilen Bodrum Kent Konseyi (BKK) seçimleri mahkeme kararıyla iptal edildi. Tüm çalışma gruplarının faaliyetleri de durduruldu.

Bodrum Kent Konseyi’nin son seçimli olağan genel kurulu, 5 yıldır Bodrum Kent Konseyi başkanlığını yürüten Arif Yılmaz'ın 26 Temmuz 2024 tarihinde vefatı üzerine yapıldı. BKK'ye Yılmaz'ın vefatı ve yeni genel kurul arasındaki süreçte avukat İzzet Kayahanlı başkanlık etti. 16 Kasım 2024 tarihinde gerçekleşen seçimli genel kurulda mimar Gamze Türk Oğuz ile İbrahim Emre Köroğlu aday oldu . İlk tur oylamada sonuç alınamadı. Bu arada diğer aday yarıştan çekildiğini açıkladı.

İptale giden süreç

Mahkemenin saptamalarına göre, Gamze Türk Oğuz tek aday kaldığı için başkan ilan edilerek yürütme kurulu seçimlerine geçildi. Ve Gamze Türk Oğuz, Bodrum Kent Konseyi’nin yeni başkanı olarak duyuruldu. Bu aşamadan sonra konu yargıya taşındı. Dönemin AK Parti Bodrum İlçe Başkanı Yaşar Yıldız'ın Muğla 3. İdare Mahkemesi’ne sunduğu dava dilekçesinde şu iddialar öne çıktı:

"Kendi partisi de dahil olmak üzere kentteki bazı siyasi partilere resmi davet gönderilmedi.

Önemli sivil toplum kuruluşları (STK) genel kurul sürecinin dışında bırakıldı.

Bu eksiklikler, seçimin hukuka, usule ve demokratik temsil ilkesine açıkça aykırı olmasına neden oldu."

Bodrum Kent Konseyi’nin 16 Kasım 2024 tarihinde Herodot Kültür Merkezi’nde yapılan seçimli genel kurulu, mahkemenin genel kurul katılım, oylama, davetiye listeleri, imza föyleri ve oy tutanakları ile tüm diğer belgeleri talep edip incelemesinin ardından geçersiz sayıldı.

Mahkemenin kararında şu görüşler yeraldı;

"Öte yandan dava konusu Bodrum Kent Konseyi’nin 16.11.2024 tarihli seçimli olağan genel kurulunda kent konseyi başkanı seçimine ilişkin süreç incelendiğinde, seçime ilişkin olarak tutulan 4 sayfalık tutanağın ilk iki sayfasının kaybedilerek dava dosyasına ibraz edilmediği, düzenlenen tutanağın 3. ve 4. sayfası incelendiğinde seçimde iki adayın başkanlık için yarıştığı, ilk turda hiçbir adayın yukarıda yer verilen yönetmeliğin 11/a maddesinde belirtilen üye tam sayısının üçte iki çoğunluğunu sağlamadığı, adaylardan E.K.’nın seçimden çekilmesi üzerine ikinci tura geçilmediğinin belirtildiği görülmüş olup yukarıda yer verilen mevzuat incelendiğinde kent konseyi başkanının seçimle belirleneceğinin düzenlendiği, seçime tek aday katılması veyahut adaylardan birinin çekilmesi halinde tek adayın doğrudan başkan seçileceği yönünde bir düzenleme olmaması karşısında, genel kurulda kent konseyi başkan adayı olarak tek bir kişinin bulunması halinde de anılan adayın mezkur yönetmeliğin 11/a maddesinde bulunan seçilme yeterliliği yönünden öngörülen usulde oylanarak kabulü ya da reddi şeklinde oylama yapılması gerekirken bu usul işletilmeksizin doğrudan başkan kabul edilerek yürütme kurulu seçimine geçildiği görülmüştür.

Bu durumda; Bodrum Kent Konseyi’nin 16.11.2024 tarihli seçimli olağan genel kurul divan tutanaklarının özensiz şekilde hazırlanarak yarısının kaybedildiği hususu ile toplantı çağrısı ve kent konseyi başkanı seçim süreçlerinin Kent Konseyi Yönetmeliği’ne aykırı olarak icra edildiğinin anlaşılması karşısında, Bodrum Kent Konseyi’nin 16.11.2024 tarihli seçimli olağan genel kurulunda hukuka uyarlık bulunmadığı sonucuna ulaşılmıştır."

Muğla 3. İdare Mahkemesi'nin iptal kararı yeni seçimi gündeme getirdi. BKK'da seçim sürecini Bodrum Belediye Başkanlığı'nın yürüteceği belirtildi.

BKK'den sürece dair açıklama

Öte yandan genel kurul iptal kararı üzerine BKK'den yazılı açıklama yayınlandı. Açıklamada, AKP Bodrum eski İlçe Başkanı Yaşar Yıldız’ın açtığı dava sonucunda, 16 Kasım 2024 tarihinde gerçekleştirilen seçimli olağan genel kurula dair Muğla 3. İdare Mahkemesi’nin 2025/293 Esas ve 2026/285 Karar sayılı ilamı ile işlemin iptaline karar verildiği ifade edildi.

Çalışma gruplarının faaliyetleri durduruldu

Bodrum Kent Konseyi açıklamasında yeni genel kurul yapılıncaya kadar, Bodrum Kent Konseyi çatısı altında faaliyet sürdüren tüm meclisler ve çalışma grupları dahil olmak üzere mevcut yapıların faaliyetlerinin Bodrum Belediye Başkanlığı'nın bildirimiyle durdurulduğu da ifade edildi.

Bodrum Kent Konseyi açıklamasında Kadın Meclisi ve diğer tüm çalışma grupları ile mahalle çalışma gruplarının yapılacak genel kurul sonrasında göreve gelecek olan yeni Kent Konseyi yönetiminin kararlarıyla şekilleneceği bilgisi de yer aldı.

"AKP Bodrum Eski İlçe Başkanı Yaşar Yıldız’ın Bodrum Kent Konseyine açtığı dava sonucu Bodrum Kent Konseyi’nin 16.11.2024 tarihinde gerçekleştirilen seçimli olağan genel kuruluna ilişkin olarak, Muğla 3. İdare Mahkemesi’nin 2025/293 Esas ve 2026/285 Karar sayılı ilamı ile söz konusu genel kurulda gerçekleştirilen işlemin iptaline karar verilmiştir.

Anılan mahkeme kararı doğrultusunda;

• 16.11.2024 tarihli genel kurulda gerçekleştirilen Kent Konseyi Başkanlığı ve Yürütme Kurulu seçimleri hukuki geçerliliğini yitirmiştir.

• Bu kapsamda, Kent Konseyi organlarının yeniden oluşturulmasına yönelik süreç, Bodrum Belediye Başkanlığı tarafından yürütülecek olup, genel kurul ve seçim sürecine ilişkin takvim Bodrum Belediye Başkanlığı tarafından ayrıca duyurulacaktır.

• Yeni genel kurul gerçekleştirilinceye kadar, Kent Konseyi bünyesindeki mevcut organ ve yapıların (meclisler ve çalışma grupları dahil) faaliyetlerinin durdurulduğu bilgisi Bodrum Belediye Başkanlığı tarafından bildirilmiştir."

Bodrum City Council Elections Canceled

The Bodrum City Council (BKK) elections held in 2024 have been canceled by court order. All working group activities have also been suspended.

The last elective general assembly of the Bodrum City Council was held following the death of Arif Yılmaz, who had served as the council's president for five years, on July 26, 2024. During the period between Yılmaz's death and the new general assembly, lawyer İzzet Kayahanlı served as the BKK president. At the elective general assembly held on November 16, 2024, architect Gamze Türk Oğuz and İbrahim Emre Köroğlu were candidates. The first round of voting ended without a result. Meanwhile, the other candidate announced their withdrawal from the race.

The Process Leading to Cancellation

According to the court's findings, since Gamze Türk Oğuz was the sole candidate, she was declared president, and elections for the executive board were held. Gamze Türk Oğuz was then announced as the new president of the Bodrum City Council. Following this, the matter was taken to court. The following allegations were made in the lawsuit filed with the Muğla 3rd Administrative Court by Yaşar Yıldız, then the AK Party Bodrum District Chairman:

"Official invitations were not sent to some political parties in the city, including his own party.

Important civil society organizations (CSOs) were excluded from the general assembly process.

These shortcomings caused the election to be clearly contrary to the law, procedure, and the principle of democratic representation."

The Bodrum City Council's elective general assembly, held on November 16, 2024, at the Herodotus Cultural Center, was declared invalid after the court requested and examined the general assembly attendance, voting, invitation lists, signature sheets, and vote minutes, as well as all other documents.

The court's decision included the following opinions:

"On the other hand, when examining the process regarding the election of the city council president at the Bodrum City Council's ordinary general assembly held on November 16, 2024, it was observed that the first two pages of the four-page minutes of the election were lost and not submitted to the case file. Upon examination of pages 3 and 4 of the minutes, it was seen that two candidates competed for the presidency, that in the first round neither candidate secured the two-thirds majority of the total number of members specified in Article 11/a of the aforementioned regulation, and that a second round was not held due to the withdrawal of candidate E.K. Upon reviewing the aforementioned legislation, it is stipulated that the city council president shall be determined by election. Given that there is no provision for the direct election of a single candidate if only one candidate participates in the election or if one of the candidates withdraws, even if there is only one candidate for the city council presidency at the general assembly, the acceptance or rejection of that candidate should have been determined by voting according to the procedure stipulated in Article 11/a of the aforementioned regulation regarding eligibility for election." It has been observed that the election of the executive board was proceeded with directly accepting the president without any prior procedures.

In this case, given that the minutes of the Bodrum City Council's elective general assembly held on November 16, 2024, were carelessly prepared, with half of them lost, and that the meeting call and the election process for the city council president were carried out in violation of the City Council Regulations, it has been concluded that the Bodrum City Council's elective general assembly held on November 16, 2024, was not in compliance with the law.

The Muğla 3rd Administrative Court's decision to annul the meeting brought a new election to the agenda. It was stated that the Bodrum Municipality will conduct the election process within the City Council.

Statement from the City Council regarding the process

Meanwhile, a written statement was issued by the City Council regarding the annulment of the general assembly. The statement indicated that, as a result of a lawsuit filed by Yaşar Yıldız, the former AKP Bodrum District Chairman, the Muğla 3rd Administrative Court, in its ruling numbered 2025/293 and 2026/285, annulled the general assembly election held on November 16, 2024.

Working Group Activities Suspended

The Bodrum City Council statement also indicated that, until a new general assembly is held, the activities of all existing structures, including all councils and working groups operating under the Bodrum City Council, have been suspended by notification from the Bodrum Municipality.

The Bodrum City Council statement also noted that the Women's Council and all other working groups, as well as neighborhood working groups, will be shaped by the decisions of the new City Council administration that will take office after the general assembly.

"As a result of the lawsuit filed by Yaşar Yıldız, the former AKP Bodrum District Chairman, against the Bodrum City Council, the Muğla 3rd Administrative Court, in its ruling numbered 2025/293 and 2026/285, decided to annul the proceedings of the Bodrum City Council's elective general assembly held on November 16, 2024.

In accordance with the aforementioned court decision:

• The elections for the City Council Presidency and Executive Board held at the general assembly on November 16, 2024, have lost their legal validity.

• In this context, the City Council..."

The process for restructuring the City Council's organs will be conducted by the Bodrum Municipality, and the schedule for the general assembly and election process will be announced separately by the Bodrum Municipality.

• The Bodrum Municipality has informed us that the activities of the existing organs and structures within the City Council (including assemblies and working groups) have been suspended until the new general assembly is held.
